Wyoming Felonies Wyoming defines a felony as an offense that can have a criminal
punishment of at least one year in prison. The state of Wyoming does
not separate its felonies into different classes, like most other
states do; instead each felony is placed into a category with a degree.
Each category has its own punishment range. For example aggravated
robbery is a higher degree of offense than simple robbery, thus
aggravated robbery carries more serious punishments. Felonies and
misdemeanors are similar but have different grades of punishment based
on the severity of the crime. Felony sentences are served in state or
federal prisons while misdemeanor sentences are served in county or
local jails.
Murder in the first degree is the most severe felony in Wyoming and can
be punished by life in prison without parole, by life in prison, or by
death. Death is a possibility, depending on the circumstances, because
Wyoming allows the capital punishment. Sexual assault in the first
degree can be punishable by as few as five years in prison and as much
as fifty years in prison but no more. Aggravated robbery is the offense
of robbery while using a deadly weapon and is punishable by no more
than twenty-five years in prison and no less than five years.
Aggravated vehicular homicide can have punishments as high as twenty
years in prison for a single offense. Kidnapping charges vary depending
on the circumstances. If the child is released voluntarily, is
unharmed, and is in a safe environment before the trial commences, then
the maximum punishment can be as high as twenty years in prison. If the
child is not released voluntarily, is unharmed, and is in a safe
environment before the trial commences, then the individuals is subject
to sentencing no less than twenty years to as much as life in prison.
Sexual assault in the second degree carries punishments no greater than
twenty years in prison and no less than two years in prison. Arson in
the first degree can have punishments as high as twenty years and no
more with a fine no more than twenty thousand dollars. This fine can
also be twice the insurance amount of damages caused by the fire when
the fire was started for insurance collection purposes. Larceny can
have punishments no greater than ten years in prison with or without a
fine of no more than ten thousand dollars. This fine is possible if the
property value exceeds one thousand dollars. Driving under the
influence is a felony charge that can have imprisonment sentences up to
ten years with or without a fine as much as five thousand dollars. This
felony charge can have longer prison terms depending on the number of
prior offenses.
Wyoming Felony Expungement The state of Wyoming does not allow any felony offense to be
expunged from an individual's records. The felonious records may only
be expunged if the charges were dismissed in court or if there was no
prosecution against the individual. No statutes of limitations exist
for prosecuting felonies on Wyoming.
